Gate: Morning Steps

These Terms of Use ("Terms") are an agreement between you and Pointed Designs LLC ("we," "us," or "our"), a Florida limited liability company, governing your use of the Gate app ("Gate", “Gate: Morning Steps”, or "the app"). By downloading or using Gate, you agree to these Terms. If you do not agree, please do not use the app.
Gate is a wellness app that helps you build a morning habit. You choose apps on your phone to lock, a step goal, and a schedule. When your gate is active, Gate uses Apple's Screen Time (Family Controls) system to keep those apps closed until you reach your step goal or a time you set, whichever comes first. Gate reads your step count from your device's motion sensor to know when you've reached your goal.
Gate is a tool to support your own goals. It is not a medical, health, or fitness professional service, and it does not provide medical, health, or fitness advice. See Section 7.
Gate requires an iPhone with a compatible version of iOS and depends on Apple system features to work, including Screen Time / Family Controls, Motion & Fitness, notifications, and alarms. You grant these permissions through iOS. Gate cannot function without them, and you can review or change them at any time in your iPhone's Settings. Gate's blocking is enforced by Apple's system, and its reliability depends on that system and on your device's behavior.
Important: You choose which apps Gate locks. Gate cannot see the names of the apps you select, so it cannot warn you if you lock something you may need. You are responsible for leaving unlocked any apps you might need in an emergency or for urgent communication — for example, Phone, Messages, Maps, or medical apps. Do not rely on Gate to keep any essential or emergency function available.
Gate always provides ways to open your apps before reaching your step goal — including a scheduled time at which the gate comes down on its own, and manual options within the app — but you should never place yourself in a situation where being unable to open a locked app immediately could cause harm.
Gate offers auto-renewing subscriptions and a one-time lifetime purchase, sold through Apple's In-App Purchase system.
Pricing. Current prices are shown in the app before you buy. Subscriptions are offered on a monthly and an annual basis; a lifetime option is available as a single purchase. Prices may change; any change will be shown to you before it applies to you.
Free trial. New subscribers may be offered a free trial. If you start a free trial, you will not be charged during the trial period. Unless you cancel at least 24 hours before the trial ends, your subscription will automatically begin and your Apple Account will be charged. Trial eligibility is determined by Apple and is generally limited to one per Apple Account. If you are not eligible for a trial, the app will show the regular price without trial language.
Auto-renewal. Subscriptions renew automatically at the end of each period unless you cancel at least 24 hours before the period ends. Your Apple Account is charged for renewal within 24 hours before the current period ends.
Managing and canceling. You manage, cancel, or change your subscription in your Apple Account settings (Settings > your name > Subscriptions), not in Gate. Because Apple handles all billing, we cannot cancel or change your subscription for you.
Refunds. All purchases are processed by Apple, and refunds are handled by Apple under Apple's policies. We do not process payments and cannot issue refunds directly. You can request a refund through Apple.
The lifetime purchase is a one-time payment that grants access to the app's then-current gated features for as long as the app remains available and functional on supported devices. It is not a promise of perpetual service regardless of platform changes; if Apple's systems that Gate depends on change or are discontinued, features may be affected. The lifetime purchase does not include a free trial.
If your subscription lapses. If your subscription ends or a payment fails and is not resolved, Gate stops arming new gates and unlocks your apps. Gate will never keep your apps locked as a way to pressure you into paying. Losing access simply means the gate no longer runs.
You agree to use Gate only for its intended personal, lawful purpose. You agree not to attempt to reverse-engineer, tamper with, or misuse the app in ways that could harm the app, other users, or Apple's systems, except where such restriction is prohibited by law.
Gate, including its design, code, name, and content, is owned by Pointed Designs LLC and protected by law. These Terms do not grant you ownership of the app; they grant you a personal, non-transferable, revocable license to use Gate on devices you own or control, consistent with Apple's App Store Terms of Service.
Gate is a general wellness and habit tool. It is not a medical device and does not diagnose, treat, or prevent any condition. Step goals and any suggestions in the app are general and not tailored to you. Gate is not a substitute for professional medical, health, or fitness advice. Consult a qualified professional before beginning any new physical activity, and use your own judgment about what is safe for you. Do not use Gate in any way that could compromise your safety or your ability to respond to an emergency.
Gate is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not warrant that Gate will be uninterrupted, error-free, or that its blocking will always work as intended — its behavior depends on Apple's systems and your device, which we do not control. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Pointed Designs LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of or inability to use Gate — including any consequence of an app being locked or failing to lock. To the fullest extent permitted by law, our total liability for any claim relating to Gate will not exceed the amount you paid us for the app in the twelve months before the claim, which for purchases made through Apple may be zero as to us directly. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and, where appropriate, note the change in the app. Your continued use of Gate after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, except where mandatory consumer-protection laws of your place of residence apply. Any dispute not subject to those consumer laws will be handled in the state or federal courts located in Florida.
Gate is distributed through the Apple App Store. Apple is not a party to these Terms and is not responsible for Gate or its content. Apple has no obligation to provide support or maintenance for Gate. To the extent Apple's App Store Terms of Service conflict with these Terms as to your use of the app obtained through the App Store, Apple's terms govern that conflict. You agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and may enforce them.
